How to Find out if Someone has Car Insurance

Car insurance going over car accident damage

Car Accidents – No Car Insurance? Hit and Run? A Lawyer May Help

If you find yourself in a car accident, one of the first steps post-accident is finding out if the other party has car insurance.

A recent study showed that Los Angeles county ranked number one for victims killed and injured in vehicular accidents. With so many accidents, you may end up in one traveling to work or picking up dinner. Below are some tips for finding out if the other person involved in the accident has car insurance.

After you ensure you and the other party are OK, you should exchange insurance information with them. California Vehicle Code 16025 requires the exchange of name, address, driver’s license number, address, vehicle identification number, and evidence of financial responsibility (insurance).  Make sure to write down their information and take photos of the insurance card.

Anyone involved in an accident in California must file an accident report with the state whenever someone is injured, killed or if there is property damage of over $1,000 . To report your accident, you must complete and submit Form SR-1 with the California Department of Motor Vehicles within 10 days of your accident.

After completion of the form, you can request other driver’s insurance information with a different form, SR-19c . Filling this allows you to request a certificate that a driver is uninsured.

It is a possibility that the other party doesn’t have insurance, or you may have even been involved in a hit and run. Having an accident attorney on your side during this process can be helpful.  The Los Angeles attorneys at C&B Law Group can assist with the burdens brought about by such an incident.

A lawyer can help with the settlement.  Each individual car accident settlement can vary. Most of the time, your settlement will be capped at the maximum limits of the negligent driver’s insurance policy. California requires a minimum liability insurance coverage of $15,000 per person, $30,000 per accident, and $5,000 for property damage.
